This website is operated by Lockheed Tree Master Company. We encourage you to read these Terms of Use, our Privacy Policy, and any other relevant terms related to our programs, referred to as the "Terms, These documents contain essential information regarding your legal rights and obligations, including potential limitations and exclusions that may apply to you. By accessing this site, you agree to comply with these legally binding Terms and Conditions. If you do not agree, we kindly ask you not to use the site.
By accepting our quote, the Client (either you or the designated property manager) enters into a contract with Lockheed Tree Master and agrees to the following terms and conditions.
Section 1
Bookings, Deposits, Scheduling, Cancellations
Upon acceptance of the quote, customers may be required to pay a 50% deposit of the amount via cash or credit card if the quote exceeds $1,000. Once Lockheed Tree Master (LTM) receives the deposit, we will schedule an appropriate workday. Cancellations made within three business days of the scheduled date will result in the forfeiture of the deposit. LTM aims to complete the contracted work within 4-6 weeks, allowing for extensions due to permit delays and inclement weather. If the customer cancels within this timeframe, their deposit will be forfeited Should LTM be unable to complete the work within 4-6 weeks, the customer may cancel the contract and receive a full deposit refund. However, if LTM has applied for a permit on the customer's behalf, full payment for the permit application is still required If the client cancels within 24 hours of the scheduled time or if our Arborist crew cannot access the site due to safety concerns, a 25% cancellation fee will apply and must be paid within three business days. Occasionally, LTM may need to reschedule accepted work in response to emergency tree situations requiring immediate action. We will prioritize rescheduling accepted work as needed.
Section 2
Site Conditions & Access, Alterations, Additional Work Requests
Immediately upon completion of the works, the customer will pay the balance due for all contracted works unless agreed to in writing before attendance. Any Credit Card payment will attract a 1.65% surcharge. Bank transfers are preferred. If the customer can not be present at that time, then prior arrangements for payment by invoice must be made. Payments not received by LTM Care within seven days of completion will attract a late payment fee of $110. A Late Payment Reminder will then be sent, including a late payment fee. If payment for the contract, including the late payment fee, is not received within 14 days, the account will be referred to a collection agency or lodgment for BC Civil Resolution Tribunal (CRT) to have the matter heard. All additional costs and fees involved in the collection will be added to the original contract price and be payable by you.
This agreement is contingent upon the site conditions at the time of quoting. Any changes that impact access or the ability to complete the contract within the estimated timeframe may necessitate a re-quote and a new contract The customer agrees to allow LTM and its contractors full and easy access to the site as needed to perform the work. The customer is also responsible for ensuring the site remains clear of other individuals, children, animals, and pets during the project. Any additional work requested that is not included in the original contract will be addressed at the crew's discretion on the day service. If it aligns with our schedule, the crew will provide an estimate and amend the contract accordingly, which will require your signature for any changes. Please note that some requests may be unfeasible on the day due to Tree Permit regulations.

Permits
The customer acknowledges that all work under this contract is confined to the aforementioned. The customer is responsible for securing all necessary approvals and permits as required by Federal or Provincial Law, Town Planning, Vegetation Protection Overlays, and must provide LTM with copies prior to the start of any work. If the work is to be conducted on a site not owned by the customer, LTM will require the site owners to complete and sign an authorization form. Additionally, it is the responsibility of the tree owner to contact their City office to verify whether a Permit is needed for Tree Pruning or, or to disclose any Planning Permits affecting the property that mayede Local Law Tree Permit Applications. LTM will not be liable for any Special Conditions associated with an approved Permit issued by the City Office or for any requirements related to replacing vegetation or Infringement Notices issued to the property.
Section 5
Tree Removals
customer acknowledges and understands the following terms: “Removed to ground level” or “Removed to base level means the tree will be cut down as low as possible with a chainsaw, typically leaving a stump height of 2-4cm. The chainsaw operator will determine how the cut can be made without risking damage to the equipment. The term “Timber cut to firewood size” indicates that logs will be cut into blocks approximately 300-400mm long, suitable for splitting, but splitting is not included unless specified. Additionally, wood remains on-site” means that the cut wood blocks will be left in convenient location without being moved or stacked, unless otherwise noted.
Stump grinding is an underground process where the operator is shielded from debris by guards, limiting visibility of the working head. Consequently, underground services may be at risk of damage during these operations. LTM is not liable for any damage to nearby garden bed pavers, timber sleepers, decking, bricks, or concrete borders (though we will exercise care based on clear access) or for any disruption of underground services such as power, water, gas, telephone, data, and irrigation. The term "Stump Removal" or "Stump Grinding" refers to the removal of a stump using a stump grinding machine, which typically covers an area 1.5 times the stump's diameter and reaches depths of 200-450mm. However, access limitations and surrounding obstacles like fences and concrete may affect the area processed. Stump grinding debris (mulch) will remain on-site unless otherwise specified, and the ground mulch will fill the hole, though larger stumps may generate excess mulch. Stump Removal/Grinding does not include the removal of visible or hidden roots beyond these dimensions unless outlined. Prior to any stump removal or grinding, you must inform LTM of any underground services such as electricity, water, gas, telephone, or irrigation. For clarification on service locations, you can contact the free service line, Before You Dig, at 1-800-474-6886. LTM is not responsible for any damage or disruption to these services. Given site conditions and access, we will perform stump grinding to the best of our ability, with the operator determining the grinding extent without risk. If there is a risk of existing underground services, we recommend that clients either hire a professional to them, engage a service locator to assess their position and depth before grinding, or consider chemical stump control instead of stump grinding. The customer acknowledges that tree work can be high-impact, and while LTM will strive to minimize property damage, some minor disruption is to be expected, including grass wear, minor plant disturbance, and sawdust. Our team will perform the work diligently and professionally. LTM will supply all necessary equipment and labor, ensuring all equipment is well maintained and in safe, working order.

What to expect after Stump Grinding
When a tree is cut down to ground level, significant changes take place underground. The sudden stop of water and nutrient flow from the prompts a reaction in the root system, causing the roots to gradually retract and shrink to conserve energy, as they can no longer photosynthesize. This retraction creates pathways that decompose and enrich the soil, promoting the growth of new vegetation. However, it's essential to be aware that decaying tree stumps and roots can attract various pests, such as termites, fungi, beetles, carpenter ants, and carpenter bees. It's recommended to wait at least two years before planting a new tree in the same location to allow for complete decomposition, and ideally, new trees should be planted at least 6 to 8 feet away from any remaining stumps or roots.

Employees, Sub-Contractors, Agents
Chikara typically employs its own staff but may hire subcontractors as needed. Any contractors engaged will be expected to carry out their tasks diligently and professionally, using equipment that is safe and well-maintained. LTM guarantees that its employees, agents, and subcontractors possess the required skills and training to complete the work effectively.
Section 10
Insurance
Chikara any contractors it engages will maintain public liability insurance at least $20,000,000. Additionally, they will possess all necessary Workers' Compensation Insurance for any workers operating on-site.
Section 11
Site Access
Chikara, mandates a safe work environment for all jobs to the extent that it can be reasonably ensured. Clients are responsible for providing safe access to the work site from the road verge, free of trip hazards, with a required width of 2 meters unless an alternative is agreed. If LTM arrives at the site on the scheduled date but cannot proceed due to safety or access issues, a call-out fee may be applied, at LTM's sole discretional mandates a safe work environment for all tasks to the extent that it can be reasonably ensured. Clients are responsible for ensuring safe access from the road verge to the work site, free from trip hazards, with a width of 2 meters unless a arrangement is made. A call-out fee may apply if LTM arrives on the scheduled date and is unable to complete the work due to safety concerns or access. This fee is determined solely by LTM's discretion.

General Definition
Kindly note that payment in full is required on the day the tree work is conducted. Should the project extend beyond one day, partial payments will be invoiced at the conclusion of each working day until the job is completed.
DEPOSITS:
DEPOSITS: For projects exceeding $2,000, or in instances where equipment is rented are engaged, a deposit may be required upon request and must be paid 14 days in advance. deposit will be either 50% the total job value or the cumulative of all rental and contract fees, whichever is greater.
PAYMENTS: A credit card number may be required upon confirming the booking date and, with payment processed after the work is completed, unless otherwise specified writing by management. A 1.65% surcharge apply. We prefer bank transfers for invoiced payments. We accept cash, bank deposits, Visa, and Mastercard. Please note that we do not accept checks or AMEX card payments. A 1.65% surcharge will apply for credit card payments unless agreed upon by management.
PERMITS: Should Chikara act on behalf of the property owner, a non-refundable application fee of $175 will be invoiced for payment prior to the submission to the city. Upon acceptance of this quote a Tax Invoice and Owners Consent form will be provided via email. It is the responsibility of the tree owner to verify their City whether a Permit is required for Tree Pruning or Removal and to disclose any Planning Permits linked to the property, as these may take precedence over any city Law Tree Permit Applications.
Commercial Transaction Terms: Net terms of 14 days are available exclusively to commercial accounts upon approval of a completed credit application. If a Real Estate Agent or Body Corporate Management is involved, a credit card from the Landlord or OC Manager may be required to confirm the booking for tree works. All Body Corporation accounts must be settled in full on the day the tree works are completed, unless otherwise arranged by Management. A Tax Invoice will be issued the account holder the day prior to the scheduled tree works.
LATE PAYMENTS: Accounts that remain overdue by more than 14 days may be subject to a $110 Administration Penalty for any outstanding Tax Invoices. The imposition of this penalty is at Chikara's discretion, and clients will receive written notification accordingly.
CANCELLATIONS: Chikara reserves the right to reschedule a booking as necessary to prioritize any emergency Make Safe that requires our immediate attention. We will notify you promptly and work to reschedule the job at a mutually convenient time. If a quote has been accepted, scheduled, and confirmed, and you (the client) cancel within 24 hours, or if site access is not available as agreed, a fee of 25%-50% of the accepted quote will be invoiced for payment on the same day, in accordance with our Terms of Trade, unless otherwise determined by management. emphasize the importance of communication; failure to communicate from the client may result in debt recovery procedures.
ACCESS: In the event that site access is not available as stipulated, or our Arborist Crew identifies safety concerns on the day of work that cannot be promptly resolved, or if the job is unable to be completed, 50% the accepted quote price will be invoiced for payment on that day in accordance our Terms of Trade, unless an alternative arrangement is made by Management. Furthermore, a minimum call-out fee of $500 plus GST (non-refundable) will be charged on the day if the accepted quote is less than $1,000.
